Rubbish Removal Shoreditch Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Shoreditch provides rubbish removal, waste collection and related services within the United Kingdom. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal work carried out by us.

1.2 We, us, our means Rubbish Removal Shoreditch, operating as a UK-based waste removal service provider.

1.3 You, your, customer means the individual, business, landlord, tenant, managing agent or organisation that books or uses our Service.

1.4 Booking means a confirmed request by you for the provision of our Service, whether made by telephone, email, online form or any other agreed method.

1.5 Premises means the location where the waste is to be collected or where the Service is to be performed.

1.6 Waste means any items, materials or rubbish that you request us to collect and remove, excluding any items prohibited under these Terms or by law.

2. Scope of Service

2.1 We provide rubbish removal and waste collection services, including domestic, commercial and office clearances, subject to these Terms and any specific arrangements agreed with you at the time of booking.

2.2 The exact scope of the Service, including the estimated volume of waste, access to the Premises, timings and any special requirements, will be agreed at the time of booking or during our on-site assessment.

2.3 We reserve the right to refuse to collect any Waste that we reasonably believe to be hazardous, illegal, excessively heavy, unsafe to handle, or not as described at the time of booking.

3. Booking Process

3.1 You may request a quotation and make bookings by telephone, email or via our online channels where available.

3.2 In order to provide an estimate, we may request photographs, descriptions of the Waste, approximate quantities or access details. All estimates are provided in good faith based on the information supplied by you.

3.3 In some cases, we may need to carry out an on-site assessment before confirming the final price. If the actual Waste or circumstances at the Premises differ significantly from the information you provided, we reserve the right to amend the price accordingly or decline the Service.

3.4 A Booking will be deemed confirmed once we accept your request and provide you with a scheduled collection date and, where applicable, a price estimate or quotation.

3.5 It is your responsibility to ensure that all details provided at the time of booking, including contact information, address, access instructions and description of Waste, are complete and accurate.

4. Access and Customer Responsibilities

4.1 You must ensure that we have safe and reasonable access to the Premises at the agreed time to carry out the Service.

4.2 You must ensure that any necessary permissions for access, parking or entry are obtained in advance, including permits or authorisation from building managers, neighbours or local authorities where required.

4.3 If we are unable to access the Premises, or if there are significant delays due to issues within your control, we may charge a waiting fee, a call-out fee or cancel the Booking and apply our cancellation terms.

4.4 You are responsible for ensuring that the Waste you present for collection is safe to handle and does not contain prohibited items such as certain hazardous materials, clinical waste, asbestos, chemicals or pressurised containers, unless previously agreed in writing.

5. Pricing and Payments

5.1 Our charges are generally based on the volume and type of Waste, the labour involved, access conditions and any additional services required, such as heavy lifting or dismantling.

5.2 Any price given before we view the Waste is an estimate only. The final price may be adjusted after our team has inspected the Waste on site, provided that any revision is explained to you before the Service is carried out.

5.3 Unless otherwise agreed in writing, payment is due immediately upon completion of the Service. We may accept payment by cash, bank card or other methods agreed in advance.

5.4 For business customers and account holders, payment terms may be agreed separately. Invoices must be paid within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

5.5 We reserve the right to charge interest on late payments at the statutory rate in force from time to time, accruing daily from the due date until the date of payment in full.

5.6 All prices are quoted in pounds sterling and, where applicable, are subject to VAT at the prevailing rate, which will be stated on your invoice.

6. Cancellations and Amendments

6.1 You may cancel or amend your Booking by contacting us directly as soon as possible.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually apply, unless otherwise indicated in your specific Service agreement.

6.3 If you cancel within 24 hours of the scheduled collection time, we reserve the right to charge a reasonable cancellation fee to cover our administrative and scheduling costs.

6.4 If our team arrives at the Premises at the scheduled time and is unable to gain access, or if the Service cannot be carried out due to circumstances within your control, this may be treated as a late cancellation and a call-out or cancellation fee may be charged.

6.5 We may cancel or reschedule a Booking in the event of circumstances beyond our reasonable control, including but not limited to severe weather, traffic accidents, vehicle breakdowns, staff illness or safety concerns. In such cases, we will notify you as soon as reasonably practicable and arrange a new appointment. We will not be liable for any loss arising from such delay or cancellation.

7. Waste Handling and Regulations

7.1 We operate in accordance with applicable UK waste management legislation and regulations, including duties of care relating to the handling, transportation and disposal of controlled waste.

7.2 All Waste collected by us will be transferred to appropriately licensed facilities for recycling, recovery or disposal, as required by law and in line with our operational practices.

7.3 We may provide you with a waste transfer note or other documentation as required by legislation or on request. It is your responsibility to retain such documentation for your records where you are legally required to do so.

7.4 You must not present for collection any Waste that is classified as hazardous or special waste, such as chemicals, oils, asbestos, clinical waste or certain electrical items, unless we have expressly agreed in advance in writing to handle such materials and you have provided accurate information about their nature.

7.5 If prohibited or undisclosed hazardous items are found within the Waste, we may refuse to collect the load, apply additional charges for specialist handling, or return such items to you. You will be responsible for any costs, fines or losses we incur as a result of your failure to comply with these requirements.

8. Customer Property and Site Condition

8.1 You must clearly identify the Waste that is to be removed and ensure that no items intended to be kept are mixed with rubbish or left in close proximity in a way that could cause confusion.

8.2 We will not be responsible for the accidental removal of items that you have not separated or identified clearly as items to be retained. You should check the area carefully before and during collection.

8.3 We will take reasonable care to avoid damage to your property while carrying out the Service. However, you should ensure that any fragile items, valuables or obstacles are removed or suitably protected before we commence work.

8.4 We are not responsible for cleaning or repair of areas that are already soiled, damaged or in poor condition before our arrival. Our responsibility is limited to clearing the agreed Waste and, where possible, leaving the area reasonably tidy.

9. Liability and Limitations

9.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be limited or excluded under applicable law.

9.2 Subject to clause 9.1, we will not be liable for any indirect, consequential, special or punitive losses, or for any loss of profit, revenue, business, goodwill or anticipated savings arising out of or in connection with the provision of the Service.

9.3 Our total aggregate liability to you for any loss or damage arising out of or in connection with the Service, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable by you for the specific Service in respect of which the claim arises.

9.4 We do not accept liability for any delay or failure to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, accidents, road closures, vehicle breakdowns, or delays caused by third parties.

9.5 You are responsible for any loss, damage, costs or expenses we suffer as a result of your breach of these Terms, including but not limited to providing incorrect information, failing to disclose hazardous items, or obstructing access.

10. Insurance

10.1 We maintain appropriate insurances in connection with our rubbish removal and waste collection operations, including public liability insurance, as required by law and industry practice.

10.2 Details of our insurance cover are available on request. Our liability remains subject to the limitations set out in these Terms.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as possible, providing full details of your concerns.

11.2 We will investigate any complaint in good faith and aim to respond within a reasonable period. Where appropriate, we may offer to rectify the issue, provide a partial refund or propose another form of resolution.

11.3 If a dispute cannot be resolved amicably, either party may pursue their rights through the courts in accordance with the governing law set out in these Terms.

12. Data Protection and Privacy

12.1 We collect and process personal information in order to manage Bookings, deliver the Service, issue invoices and communicate with you.

12.2 We will handle your personal data in accordance with applicable data protection laws and only use it for legitimate business purposes connected with the provision of our services, administration and legal compliance.

12.3 You are responsible for ensuring that any personal data you provide to us is accurate and up to date.

13. Changes to These Terms

13.1 We may update or amend these Terms from time to time to reflect changes in our services, operational practices, legal requirements or for other valid reasons.

13.2 The version of the Terms that applies to your Booking will be the version in force at the time you make the Booking, unless changes are required by law or regulatory authorities.

13.3 We recommend that you review these Terms periodically if you use our services on a recurring basis.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service, including any non-contractual disputes or claims.

15. General Provisions

15.1 If any provision of these Terms is held by a court or competent authority to be invalid or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that or any other right or remedy.

15.3 You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to deliver the Service.

15.4 These Terms, together with any written quotation, booking confirmation or additional conditions we provide, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings or agreements, whether written or oral.

By placing a Booking with Rubbish Removal Shoreditch or by allowing our team to commence work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
